1. Call to Action/Message Flow (campaign registration form)

If the opt-in occurs on a webpage, a detailed description of the path a person needs to follow to access the opt-in form should be provided. This includes the links that the person needs to visit to get to the exact URL where the opt-in takes place must be provided. The call-to-action must inform the user of the nature of the program. It should clearly specify the exact location (include links if its a website) where it happens. Finally, for Charity and Political use cases a donation solicitations disclaimer must be included. This disclaimer must explicitly indicate if donations [will] or [will not] be solicited via text messages under this 10DLC campaign. Sample language: "Donations will be solicited." or "Donations will not be solicited."

Example: "Voters opt-in to receive text messages from [organizationName] via our website (https://organizationName.com) by entering their mobile phone number on the 'Sign-up' form (https://organizationName.com/sign-up). Donations will be solicited"

2. Phone Number Collection Form

  • Your website should have an opt-in form designed to subscribe users to communications via text messages. The the phone number field must not be mandatory when the form also collects other contact information such as email address, as it would be considered a forced opt-in. If the phone number field on the opt-in form is currently a required field, it needs to have a check box added next to the opt-in language for the user to check the box to agree to receive text messages.
  • Every other form which collects a phone number on your website must have opt-in language and a check box to be accepted by the user. Opt-in language must be specific to text messages only. It should not include email or phone call permissions—these need to be collected separately.
    Example: “By submitting this form and signing up for texts, you consent to receive text messages from [Organization name] at the number provided. Msg & data rates may apply. Msg frequency varies. Text HELP for more information. Unsubscribe at any time by replying STOP. Privacy Policy [link] & Terms [link]. Donations will be solicited”

3. Privacy Policy:

The organization’s website must have a published Privacy Policy. This policy must explicitly prohibit the sharing or selling of phone number information for promotional or marketing purposes. The language should directly address phone number sharing, ensuring it states something like: "No mobile information will be sold or shared with third parties for promotional or marketing purposes."

Important Notes:

  • A link to the Privacy Policy must be provided during the campaign registration process.
  • As previously mentioned, a link to the Privacy Policy should also be included in the consent language of any form used to collect phone numbers.
